I'WHealthY Catering Services: Terms and Conditions

These Terms and Conditions (“Terms”) govern the ordering and provision of catering services (the “Services”) by i'whealthy (the “Caterer”) to the client (the “Client”). By placing an order, the Client agrees to be bound by these Terms.

1. Ordering and Confirmation

1.1. Request for Services: All catering requests must be submitted to the Caterer with sufficient advance notice, as mutually agreed upon.

1.2. Minimum Order: The Caterer reserves the right to enforce a minimum order quantity or value, which will be communicated at the time of inquiry or upon order placement.

1.3. Order and Acceptance: The Caterer provides a detailed order confirmation detailing the specific baked goods/products ordered, services, date, location, and total cost immediately upon successful placement of an order. A binding contract is formed when the Client submits payment and the Caterer provides electronic confirmation of the accepted order.

1.4. Order Quantity Responsibility (Baked Goods): The Client is solely responsible for determining the specific type and quantity of baked goods, pastries, or other items required for their event. The Caterer may provide general recommendations on product quantity based on any estimated number of guests the Client provides, but this advice is purely advisory. The Caterer assumes no liability if the quantity ordered is insufficient for the actual number of guests or needs of the event.

2. Pricing, Payments, and Cancellations

2.1. Full Payment Required: Full payment of the total estimated cost is required at the time the order is placed to confirm the booking.

2.2. Payment Methods: Payments are accepted via [Specify acceptable payment methods, e.g., credit card, bank transfer, cashier's check].

2.3. Cancellation by Client:

* If cancellation occurs more than fourteen (14) days before the event, the Client will receive a refund equal to fifty percent (50%) of the total contracted cost.

* If cancellation occurs within seven (7) days of the event, the full payment is non-refundable and the Client is liable for 100% of the total contracted cost.

2.4. Cancellation by Caterer: If the Caterer must cancel the Services due to unforeseen circumstances (including, but not limited to, natural disasters, severe weather conditions preventing safe travel, unexpected illness or injury of the Caterer, or equipment failure), all payments made by the Client will be immediately refunded.

3. FLORIDA COTTAGE FOOD OPERATIONS DISCLAIMER

THE CLIENT ACKNOWLEDGES AND AGREES TO THE FOLLOWING MANDATORY DISCLOSURE, AS REQUIRED BY THE FLORIDA DEPARTMENT OF AGRICULTURE AND CONSUMER SERVICES (FDACS):

The Client understands that all food and beverage items are prepared in accordance with Florida Statute Section 500.80 and are not prepared in a commercial, licensed food establishment. The Client assumes all risk associated with consuming food prepared under cottage food operation regulations.

4. Product Quality and Ingredients

4.1. Preparation and Standards: All baked goods and products are prepared by a team that includes a certified nutritionist and experienced vegan chefs. The preparation takes place in a dedicated, plant-food based kitchen environment, adhering to strict food safety and handling standards in accordance with state cottage food operation guidelines. All ingredients used are all-natural and organically sourced without compromise. Products are free of all artificial additives and preservatives, resulting in a naturally short shelf life.

4.2. Allergen Control and Purity: The Caterer’s preparation kitchen is entirely free of animals, animal by-products (including meat, dairy, eggs, and honey used in preparation), and household pets of all kinds to ensure the purity of the plant-based offerings.

4.3. Consumption Policy and Shelf Life: Due to the absence of preservatives, the baked goods must be consumed by the recommended "Best By" date provided by the Caterer. The Client must perform a close inspection of any baked goods nearing or past this date, and they must be safely discarded if the quality, texture, or freshness appears compromised.

5. Delivery and Acceptance

5.1. Delivery: The Caterer will coordinate a specific delivery time. Delays outside the Caterer’s control (e.g., traffic, adverse weather) are not the responsibility of the Caterer.

5.2. Delivery Information and Redelivery: The Client is responsible for providing accurate and complete delivery address and contact information. If the Caterer is unable to complete delivery due to incorrect information or the Client (or representative) not being present at the agreed time, the Client may be charged a redelivery fee, or the order may be considered fulfilled and non-refundable.

5.3. Delivery Location and Access: The Client is responsible for ensuring the delivery location is accessible and that adequate space is available for setup.

5.4. Delivery Inspection and Acceptance (Mandatory): The Client (or an authorized representative) must conduct a full inspection of all delivered baked goods and products at the time of delivery. The Client must sign an acknowledgment affirming that the order was delivered as expected, in satisfactory condition, and complete. Any issues, discrepancies, or damage must be reported to the Caterer immediately at the time of inspection to allow the Caterer an opportunity to offer a solution. The Caterer is not responsible for any issues reported after the delivery representative has left the premises.

5.5. Client Food Safety Responsibility: The Client is responsible for the safe handling and storage of food after delivery. The Caterer is not responsible for food quality or safety once it has been delivered and is no longer under the Caterer's immediate control, particularly if recommended holding temperatures are not maintained.

6. Product Labeling and Ingredient Disclosure

6.1. No Individual Labeling: Due to the nature of catering event orders, individual baked goods will not be separately packaged or labeled with ingredient information, nutritional facts, or allergen warnings.

 6.2. Ingredient List Provision: The Caterer will provide the Client with a comprehensive list of ingredients for each unique baked treat in the order. This list will be provided on a standard-size sheet delivered by email.

 6.3. Branding: The provided ingredient list sheet will prominently feature the I'Whealthy logo. The Client is responsible for displaying this information clearly for their guests.

7. Delivery Charges and Surcharges

7.1. Standard Delivery Zone: Delivery is provided free of charge for locations within a ten (10) mile radius of zip code 33071. 

7.2. Surcharge Calculation: Deliveries requested to locations exceeding the ten (10) mile radius will incur a delivery surcharge. This charge will be assessed by the Caterer after the initial order is placed and reviewed. 

7.3. Invoicing and Payment: The Client will receive a separate invoice for the delivery surcharge via email within twenty-four (24) hours of placing the order. * Payment Deadline (Event > 14 Days Away): If the scheduled event date is more than fourteen (14) days away, the delivery surcharge must be paid within two (2) business days of receiving the invoice. * Payment Deadline (Event 14 Days Away): If the scheduled event date is fourteen (14) days away or less, the delivery surcharge must be paid within one (1) business day of receiving the invoice.

 7.4. Order Status: The order will not be fully confirmed, and the Services will not be scheduled for fulfillment, until the delivery surcharge invoice is paid in full by the specified deadline. Failure to pay the surcharge within the deadline may result in the order being cancelled under the terms outlined in Section 2.3.

8. Limitation of Liability

8.1. The Caterer’s liability for any claim, including but not limited to claims of negligence, breach of contract, or foodborne illness, shall not exceed the total cost of the Services paid by the Client. 8.2. The Caterer shall not be liable for any indirect, incidental, or consequential damages resulting from the provision of the Services.

By confirming an order and submitting a payment, the Client acknowledges that they have read, understood, and agree to these Terms and Conditions.
